Dear Sir,
Whereas, TEH BEE KIM, holder of NRIC No.: S7378316Z residing at #06 - 35 151 JALAN TECK WHYE SINGAPORE 680151 (hereinafter called “the Employer”) by this insurance bond undertakes to ensure that the Employer during the employment of the domestic helper (whose particulars appear in the Schedule below as the “Domestic Helper”), shall abide and comply with the Terms and Conditions of the Standard Employment Contract for Indonesian Domestic Helper in Singapore (hereinafter referred to as “Contract”) executed by the Employer and the Domestic Helper named in the Contract duly verified and authenticated by the Embassy of the Republic of Indonesia in Singapore.

We, Liberty Insurance Pte. Ltd. having our registered office at 51 Club Street #03-00 Liberty House Singapore 069428 hereby guarantee that if the Employer breaches one or more of the Terms and Conditions of the Contract, and the Embassy of the Republic of Indonesia sends a written demand letter specifying such breach, we shall pay within thirty (30) days of the date of the demand letter the sum as demanded but not exceeding the total sum limit of Singapore Dollars Six Thousand (SGD6,000/-). 

This bond is valid from the date of issuance set out below, until the expiration of the Contract unless the Contract is prematurely terminated by the Embassy of the Republic of Indonesia as a result of any breach by the Employer or Domestic Helper of one or more of the Contract’s Terms and Conditions, upon which this bond shall automatically cease.

In no case shall this bond’s validity period be longer than twenty – six (26) months from the date of issuance. It is a condition of this bond that any written claims be made no later than seven (7) days from its expiry date.

Terms and Conditions of Indonesia Embassy Security Bond (“bond”):
1. In these terms and conditions, the "Employer" refers to the person named in the Guarantee as the employer of the Domestic Helper.
2. The Employer intends to employ an Indonesian domestic helper (the "
Domestic Helper") and is required by the Indonesia Embassy of Singapore (the "Embassy") to furnish the Embassy with a cash deposit of S$6,000/- as security (the "Cash Security") from the Employer under the terms of the Embassy's Standard Employment Contract for Domestic Helpers which is entered into between the Domestic Helper and the Employer (the "Contract").
3. Liberty Insurance Pte Ltd ("
LIBERTY") agrees to act as the Employer's guarantor by furnishing a letter of guarantee (the "Guarantee") to the Embassy in lieu of the Cash Security which the Employer is required to provide the Embassy. The Guarantee shall be valid for 26 months from the time of issuance and be in the format as set out in the Schedule of this Agreement. In the event of a breach of the terms and conditions in the Contract by the Employer, LIBERTY shall, at the demand or request of the Embassy, make payment to the Embassy up to the sum of S$6,000/-.
4. The Employer shall pay LIBERTY the sum of S$70/- (and to further include prevailing Goods & Services Tax) for the issuance of the Guarantee.
5. No refund will be payable for any early termination of this contract.
6. The Employer agrees to fully indemnify and keep indemnified LIBERTY and its successors and assigns from and against all claims, payments, demands, actions, suits proceedings, losses and liabilities, cost and expenses whatsoever, including legal fees and expenses on a fully indemnity basis, ("Claims") which may be incurred or become payable by LIBERTY under the Guarantee.
7. The Employer agrees that any claim, demand or request by Embassy for payment of any sum of money up to S$6,000/- under the Guarantee shall be sufficient authority to LIBERTY for making any such payment to the Embassy without requiring or obtaining any evidence or proof that the amount so claimed or requested is due and payable, and without requiring any notice or reference to or further authority from the Employer notwithstanding that the Employer may dispute the validity of such claim, demand or request.
8. The validity or legality of any payment by LIBERTY pursuant to the Guarantee shall not be challenged by the Employer, nor shall any liability hereunder be denied by the Employer, on the ground that such payment was not payable under such Guarantee or on any other grounds whatsoever.
9. Upon LIBERTY's written demand to the Employer for such payment, the Employer shall make payment without any deduction whatsoever of any amount paid by LIBERTY under the Guarantee. Such amount shall constitute a debt from the Employer to LIBERTY. LIBERTY's written demand to the Employer shall be conclusive evidence of the amount owing and outstanding by the Employer to LIBERTY except in the face of manifest error. In the event that any amount is not paid by the due date, the Employer understands and agrees that LIBERTY may charge interest at 8% per annum on the outstanding amount from the due date until the date full payment is received by LIBERTY.
10. The Employer shall not be discharged or released from his/her obligation under clause 6 in these bond terms by reason of any composition or payment arrangement between LIBERTY and the Employer or any forbearance by LIBERTY, whether as to payment time, amount or otherwise.
11. The Employer's obligation and liabilities hereunder are irrevocable and shall remain in full force and effect until such time that LIBERTY's obligations and liabilities under the Guarantee has been fully discharged.
12. This Agreement shall be governed by and construed in accordance with Singapore law and the parties agree to submit to the exclusive jurisdiction of the Singapore courts.
13. A person who is not a party to this Agreement shall have no rights under the Contracts (Rights of Third Parties) Act. Cap. 53B to enforce any of its terms.
14. The Employer and LIBERTY are parties, or deemed to be parties, to this agreement.
15. In any event, notwithstanding anything to the contrary, LIBERTY has an independent standing and right to enforce and/or benefit from any term herein.
